Procedure for enrolment with the Commissioner for Voluntary Organisations

In accordance with the VO Act (Cap. 492 of the Laws of Malta), Voluntary Organisations generating a Gross Annual Income of €5,000 and over are obliged to fully enrol with the Commissioner for Voluntary Organisations. In order to apply for enrolment with the Commissioner for Voluntary Organisations, an organisation has to supply the below information/documentation:

In accordance with the VO Act (Cap. 492 of the Laws of Malta), Voluntary Organisations generating a Gross Annual Income of less than €5,000 are not obliged to fu​lly enrol with this office. Instead they are obliged to inform the Commissioner with their existence  under the Second Register by clicking here to download the respective form. Voluntary organisations under the Second Register ​cannot​​ apply for Government or EU Funds.

Statute and/or Deed (Authenticated)

Statute and/or Deed (Authenticated):– which needs to be dated.

The statute / deed must be in line with the Voluntary Organisations Act (Act XXII of 2007 and The Second Schedule of the Civil Code (Act XIII of 2007). To qualify for enrolment the organisation has to be:

  • Non-Profit
  • Autonomous (No Government involvement)
  • Voluntary

That no part of the income, capital or property of the organisation shall be available directly or indirectly to any promoter, member, administrator, donor or other private interest.

Dissolution clause: (That upon winding up the organisations any remaining assets should be applied in favour of another non-profit organisation/s with similar aims).

Resolution letter

Resolution letter to enrol the organisation with the Commissioner for Voluntary Organisations. (Letter needs to be dated) 

​ Eg: We the undersigned, in our official capacity of members of the ………………………….., do herby resolve to enrol the said organisation as a ‘Voluntary Organisation’ with the Commissioner for Voluntary Organisations, in terms of Article 13 of the Voluntary Organisations Act (Chapter.492 of the Laws of Malta).

This has to be signed by all Committee / Board members and should include their Titles, Names, Surnames, and their Designations.

Copies of the Maltese ID cards (Front and Back) of all the administrators must be submitted.

 Administrators who do not possess a local ID Card are requested to submit a copy of their passport or a copy of their ID card of their country of origin [provided that such country is in the EU] and certified by a local lawyer (addresses must be included).​

Written Consent

Written consent has to be signed by all committee / Board members.(Letter needs to be dated)

Eg: We the undersigned, in our official capacity of members of the …………………………..,  declare that we consent to hold office after the enrolment of the …………………….. as a ‘Voluntary Organisation’ with the Office of the Commissioner for Voluntary Organisations, in terms of Article 13 of the Voluntary Organisations Act (Chapter 492 of the Laws of Malta).

​This has to be signed by all committee members and should include their Titles, Names, Surnames, ID Card 

A​dministrators who do not possess a local ID Card are requested to submit a copy of their passport or a copy of their ID card of their country of origin [provided that such country is in the EU] and be certified by a local lawyer (addresses must be included). 

NB: (Resolution Letter and Written Consent can be done on one document)​

Annual Accounts

Annual Accounts(Authenticated by at least 2 authorised person which should include their Names, Surnames and Designations)

Annual Report

Annual Report (Administration Report) –(Authenticated by at least 1 authorised person and should include the Name, Surname and Designation)

 

NB: (If the organisation is new (established during the current year) and no annual accounts and annual reports are available, then a statement signed by the president or any authorised person must be provided.)

Application Fee

Application Fee (40 Euro) (payable only once)– Online Payment

An Enrolled organisation will then have to submit the Annual Reports / Accounts on a yearly basis to remain enrolled with the CVO.

Beneficial Owners Document

As per subsidiary legislation 16.16 of the Civil Code (Second Schedule) (Register of Beneficial Owners / Associations) Regulations, article 6 sub article 2, voluntary organisations shall not commence activities and, or be registered in accordance with the applicable special law unless the Malta Business Registry (MBR) is satisfied that the requirements of these regulations have been complied with. The Enrolment Officer has to request applicants to register the Association / Foundation under this Act and submit the authorisation document from the Legal Persons Office.

All organisations must register the Executive Committee Members / Administrators with the Office of Registrar for Legal Persons by downloading the applicable form following the above mentioned link as indicated hereunder:

        1. Associations are required to register their Administrators under Form 1 Associations; and
        2. Foundations are required to register ther Administrators/Founders under Form 1 Foundations.

In addition, Foundations are likewise to register under subsidiary legislation 16.15. Every foundation is obliged by law to register with the Legal Persons Office. Form F issued by the Legal Persons Office is requested by the OCVO. Any change in the Administrators of a Foundation will not be entertained by the OCVO unless a duly authenticated copy of the Form A is submitted.

In the case of a foreign organisation kindly supply 

The appointment of a person resident in Malta to act as a local representative;

The acceptance by the appointed person to act as local representative.

A photocopy of the passports of the administrators (These Documents must be endorsed by a lawyer)

PS: If the organisation has a commercial outlet (for example bar (bottegin), Charity shop etc then the organisation needs to submit:

 

A signed  statement stating that  the commercial outlet  is used solely by its members; or

The latest contract for the leasing of the bar commercial outlet must be provided if it is opened to the general public; or

Documents showing that the organization has established a legal entity to run the outlet.
